Terms of service.

RacingTours B.V. - referred to hereinbelow as RT – is a company based in The Netherlands that procures tickets and/or (hospitality) services for events worldwide. By using the tickets or services, the user automatically accepts the suppliers General Terms and Conditions. RT does not assume any liability in connection with the attendance of the event. 

 

For all contracts and all orders placed with RT, the following Terms and Conditions apply exclusively.

 

General Terms & Conditions

 

Conclusion of the Contract

The customer’s offer to conclude a contract takes place by correctly submitting and sending the order to RT via email or the RT webshop. The customer will receive a confirmation e-mail, which solely informs the customer that the order has been received. The confirmation of receipt does not indicate anything about the availability of the placed order. Only after receiving the invoice from RT, the contract is concluded between the customer and RT. In case a particular category of tickets or type of services is sold out, the customer accepts that RT provides tickets or services of a similar category/type. The contract is considered to be concluded for the alternative, upon confirmation by RT. Prices and descriptions are non-binding; errors and changes are reserved.

 

Right to withdraw from the contract
As the purchased goods are related to a recreational service, the customer has no right to withdraw from the contract. (EU Distance Selling Directive) Each order of tickets or services is binding after confirmation by RT and obliges the customer to accept and pay. Accordingly, the customer does not have the right to return tickets or services. If tickets are taken back by RT as a gesture of goodwill, a handling fee of 15% of the ticket price will be retained. 

Terms of payment
All tickets and services must to be paid latest within the payment deadline shown on the invoice without any deduction. RT reserves the right to cancel invoices or vouchers at customer’s expense and to resell tickets if a payment is not made within the conditions mentioned above. 

Shipping/ Collection of tickets
All paid and confirmed tickets are dispatched at latest 2 weeks before the event at the customer’s risk according to the mode of shipment selected by the customer. Shipping methods may vary depending on the event, although RT reserves the right to offer only one shipping method. In this case tickets will be posted by registered mail or courier service. In exceptional cases or for short-term orders, RT reserves the right to make the tickets available for collection at the event venue box office. The customer will be notified about where and when to collect tickets if this is the case. 

For security reasons, Paddock Club and Champions Club tickets will be posted only 1 week before the respective Formula One race by courier service. Customers, especially when tickets are collected on site, must check tickets immediately upon receipt as later complaints cannot be accepted.

Special attention is required for e-tickets regarding protecting the ticket data. Tickets may not be used improperly, they may not be copied or modified. The principle of first admission applies - after an e-ticket has been cancelled in the course of the first admission to a service, the same e-ticket cannot be used for a further admission to the same service. By using the e-ticket, the Customer also accepts the house rules of the service provider in question.

 

Loss/ Damage
Refunds for stolen, lost or damaged tickets are not provided.

Event Cancellation/Force Majeure/ Reimbursement
RT is not liable for the reimbursement of admission charges. Should an event be cancelled, RT will make every effort to arrange a refund by the organiser. If an event is cancelled or cut short to an unforeseeable event or force majeure, the general terms and conditions and other contractual conditions of the organiser apply with regard to the reimbursement. Special contractual conditions of the organiser regarding the reimbursement (e.g. no or only partial refund in the event of force majeure) can be request by e-mail at info@racingtours.com. Based on our contractual obligation RT informs you that some organisers reserve the right to change their terms and conditions in order to adapt them to the legal and economic framework. Changes of terms and conditions will be sent to the customer to the most recently announced e-mail address. In the case of cancellation of an event, RT will withhold a handling fee of 5% of the ticket price. 

Data Privacy 
The customer accepts that her/his electronically submitted data will be electronically processed for the purpose of concluding the contract. The customer has to inform RT immediately about address change as long as purchaser and seller have not completely fulfilled the contract.

Miscellaneous

All other agreements or amendments to our terms and conditions require our written confirmation. The ineffectiveness or invalidity of individual regulations does not affect the validity of other agreements of these terms and conditions.

 

Place of Jurisdiction/ Applicable Law

Dutch law applies to RT services under the exclusion of the international principles on conflicts of law and the UN Convention on Contracts for the International Sale of Goods (CISG)
